CONDITIONS OF SALE

1. ABOUT AGUA de ORO AND THESE TERMS OF SALE
These Terms of Sale apply to all sales of Agua de Oro products or services that you may order on the www.Agua de Oro.ch website and via email.
The registered office of Agua de Oro SARL. is located at 21, Grand rue, 1204 Geneva, Switzerland (" Agua de Oro " and "we", "us" and "our"). Our VAT number is CHE-114.798.474.
By placing an order, you agree to be bound by the Terms of Use and Privacy Policy, the terms of which are incorporated into these Terms of Sale.
Please note that before ordering any products or services, you will be asked to accept these Terms of Sale.

2. UPDATES TO THESE TERMS AND CONDITIONS
We may change these Terms and Conditions at any time. Therefore, please check them regularly to be aware of any updates. The latest version will always be available on the Platforms. Any new version of these Terms of Sale will take effect immediately on the date of publication.

3. GUARANTEE
General jewellery (also applicable to any other part not described below)

Guarantee
Agua de Oro gives a three-year guarantee on your jewellery (or other product Agua de Oro) from the date of purchase. The warranty does not cover damage caused by accident (shock), lack of care or normal wear and tear of the jewellery. This guarantee also covers the loss of small diamonds (up to 0.05ct per diamond): if one of the small stones falls out of your jewel, we commit ourselves to replace it free of charge.

Service
Servicing and cleaning is offered for life.
If you have your jewellery serviced during the warranty period, the replacement service will be renewed for one year at each subsequent service.
Engagement ring:
Warranty
Agua de Oro provides a three-year warranty from the date of purchase on your engagement ring. The guarantee does not cover damage caused by accident (impact), lack of care or normal wear and tear. This guarantee also covers the loss of small diamonds (melee): if one of the small stones falls out of your jewel, we will replace it free of charge.

Service
Agua de Oro offers you a special service for your engagement ring: for two years from the date of purchase, we will refresh your ring free of charge to bring out its brilliance and we will also check the setting of the stones. We recommend that you have your jewellery checked regularly, which, depending on the use you make of it, should be done every one to three years. If one of the small diamonds (melee) falls out of your jewellery within this three-year period, we will replace it free of charge. If you come into the shop for a service within a year before the end of the guarantee, this service is renewed. We also offer you a free enlargement or shrinkage (if the variation does not exceed two numbers and you notify us of this within the first three weeks after the date of purchase)

Overhaul and cleaning are offered for life.

If you have your Wedding Band scrum service overhauled during the warranty period, the scrum replacement service will be renewed for one year at each subsequent overhaul.

Wedding rings:

Agua de Oro provides a three-year guarantee on your Wedding Band from the date of purchase. The guarantee does not cover damage caused by accident (shock), lack of care or normal wear and tear. This guarantee also covers the loss of small diamonds (melee): if one of the small stones falls out of your jewel, we undertake to replace it free of charge.

Service
Agua de Oro offers you a special service for your Wedding Band : for the first two years after purchase, we will refresh your ring free of charge to restore its brilliance and we will also check the setting of the stones. We recommend that you have your Wedding Band regularly checked, which, depending on the use you make of it, should be done every one to three years.

Overhaul and cleaning are offered for life.

If you have your Wedding Band scrum service overhauled during the warranty period, the scrum replacement service will be renewed for one year at each subsequent overhaul.

4. ACCEPTANCE OF ORDERS
We reserve the right to refuse orders and payments whose origins appear to us to be fraudulent.
5. AVAILABILITY AND QUANTITY OF PRODUCTS
All orders have a detailed production time on each product and are subject to availability of raw materials
6. ACCOUNT REGISTRATION AND VALIDATION OF PURCHASES VISITOR
You can place an order either by registering and creating an online account or by placing an order as a visitor (without creating an online account).
7. PERSONALIZED SERVICES
Customization services (e.g., engraving, design or modification) or other services may be offered on selected products.
We reserve the right to refuse acceptance of any order.
In addition, orders for customized products are not cancellable and products that have been customized in any way cannot be returned to us for exchange or refund as described in these Terms of Sale.
8. PRICES, TAXES AND DELIVERY COSTS
Unless otherwise stated, all prices shown on the product pages of the Platforms or indicated by Customer Service are in Swiss francs (CHF), including applicable VAT, but excluding delivery charges and any other taxes.
Please note that changes in the law between the date you place your order and the date you receive a written Order and Shipping Confirmation may change the taxes associated with your order. If the resulting change results in an increase in the taxes charged to you, we will contact you and ask you to reconfirm your order.

9. PAYMENT
We accept the means of payment identified as part of the ordering process. Depending on the means of payment, we may request additional information, including any special form of identification.
At the time of ordering, you will be asked to enter your payment details on the appropriate form. All payment cardholders are subject to a validation check and authorisation procedure by the card issuer. If your payment card issuer refuses to authorise payment to us, you will need to contact them directly to resolve the issue.
Other payment methods may also be subject to validation checks and authorisation procedures by payment system providers. You expressly authorise us to carry out such security checks as we deem necessary, to transmit or obtain information (including updated information) about you to or from third parties from time to time, including but not limited to your payment card details, in order to authenticate your identity, validate your payment card, obtain an initial payment card authorisation and authorise individual purchase transactions.

The total amount of your purchase will be debited when you place your order. You will receive an email confirmation of payment with details of your order and delivery time. We will also send you an email when the order has been dispatched.
We may accept any bank transfer in settlement of orders at our sole discretion. We do not charge any commission for bank transfers for orders placed through our website or Customer Service. However, some banks may charge wire transfer fees. We require that all orders paid by bank transfer and placed by telephone be confirmed through an order approval process. We may acknowledge receipt of an order paid by bank transfer, but the order will not be processed until we have received payment and confirmed its receipt by email. If your bank transfer is not credited to our bank account within seven (7) days of placing your order, your order will be cancelled.

10. ORDER ACKNOWLEDGEMENT
Once you have made your choice and placed your order via our website, you will receive an Order Acknowledgement (by email or otherwise, confirming the details of your order and an order reference number). Please keep this order reference number for future reference or enquiries regarding your order. This Acknowledgement of Order does not constitute acceptance of your order. In order to confirm the order, we will carry out the usual legal credit, fraud, security and related checks and, if satisfactory, we will then process your order. On receipt of the Order Acknowledgement, it is your responsibility to check it and confirm that it accurately reflects your ordering intentions. If you have any questions or concerns or if the Acknowledgement of Order does not reflect your intentions, you should contact Customer Services promptly.

These Terms and Conditions of Sale will be given to you as soon as we acknowledge receipt of your order.

11. SHIPPING POLICY
We only accept orders for delivery to the country(ies) identified during the Order Process. For more information, please consult our FAQ section or contact Customer Service.
12. ORDER AND SHIPPING CONFIRMATION
We will send you an Order and Shipment Confirmation in writing (by e-mail or otherwise) at the time your order is shipped. This Order and Dispatch Confirmation constitutes our acceptance of your order, indicating the existence of a legally binding contract of sale.

13. DELIVERY
We will use reasonable endeavours to ensure that delivery is made by the carrier within the estimated delivery time from the date of our written Order and Despatch Confirmation, and in any event within thirty (30) days of that date, unless your purchase is for a product or service which will require additional delivery time as explained to you, for example, in the case of products or services which we customise to your instructions.
If the delivery of products is delayed by an event beyond our control, we will inform you as soon as possible and use all reasonable endeavours to minimise the impact of the delay.
When assessing your delivery time, please take into account the time taken for payment approval, address verification, security checks and order processing. Please note that delivery is always subject to receipt of your full payment.
We will require a handwritten signature from you, or anyone at the delivery address provided, to confirm delivery of each product, after which the risk and responsibility for the products you have purchased passes to you.
14. INVOICES
After ordering products through our website, you will receive an invoice which will be sent to you in writing (to your email address as a PDF attachment or otherwise).
15. RETURNS AND EXCHANGES
(I) Right of cancellation
You have the right to cancel the order contract without giving any reason fourteen (14) days from the date on which you acquire, or any person you nominate (other than the carrier) acquires physical possession of the products in your order. If you are a customer located in the European Union or the European Economic Area and you have made a purchase through our website, this shall be deemed to be your legal right of withdrawal. In order to comply with the withdrawal period, you only need to withdraw from the contract before the expiry of the withdrawal period.
To cancel the contract and return your product(s), you can contact our Customer Service and follow the instructions given to you, or send us a written statement, such as a letter or e-mail to: sales@aguadeoro.ch.
(II) Return procedure

Only products that have been purchased through our website can be returned to: AGUA de ORO, CP5637, 1211 Geneva 11, Switzerland.
Procedure:
1. Contact us by email or phone.
2. Send your package to any Swiss Post Office (within the return period) with the Registered service.
3. You must keep a proof of return shipment, and send by Swiss Post.
4. For foreign orders, please contact us to give you precise instructions as appropriate.
(III) Conditions for returning products
We will verify that the returned product meets the conditions of the Returns and Exchange Policy and, if so, we will proceed with the applicable refund or exchange.
Our products must be returned in new and undamaged condition, with all protective materials in place and accompanied by the manual certificates and other materials sent with your order.
If you have received free items as part of your order, these must be returned with the products.
Failure to comply with these Terms of Sale will entitle us to refuse the returned product and return it to you, at your expense.

(IV) Non-exchangeable and non-refundable products
Orders for products that have been customised for you in some way cannot be cancelled and such products cannot be returned to us for exchange or refund. This includes products that have been engraved, or creations made exclusively for you.
(V) Refunds
You may return a product purchased via our website aguadeoro.ch and obtain a refund, provided that the return is in accordance with these Terms of Sale.
Only the purchaser will be entitled to a refund of the purchase price. A person who has received the product as a gift (i.e. the "Gift Recipient") will not be entitled to a refund under any circumstances. If you are a Gift Recipient and wish to return a product, please contact Customer Service to discuss your options.
If the return is in accordance with these Terms of Sale, we will use reasonable efforts to refund the purchase price to the purchaser using the same method of payment they used to pay for the original transaction within fourteen (14) days of receiving the returned product. Except in the case of delivery of a defective product by us, the original shipping charges will not be refunded.
For internet purchases no cash or card refunds will be issued for returns to our shop. For more information, please contact Customer Service.

(VI) Exchanges

You may return a product purchased through our website and exchange it for another product Agua de Oro, provided that the return complies with these Terms of Sale.
In all cases, the sale of the returned product will be cancelled and a new order for the product ordered will have to be placed.
If a product is to be returned to be exchanged for a less expensive product, only the purchaser of the returned product will be entitled to a refund of the difference in price.
If a product is returned in order to be exchanged for a more expensive one, you will be required to pay the price difference.
16. MANUFACTURER'S WARRANTY AND YOUR LEGAL RIGHTS AS A CONSUMER
We are committed to ensuring that each product meets our strict quality standards and has passed all of our tests, both technical and aesthetic.
Products purchased are covered by the applicable Agua de Oro warranty. If you wish to repair a product covered by the Agua de Oro Warranty, please refer to the applicable Agua de Oro Warranty and call our Customer Service Department for more information.
As a consumer, you may have legal rights under applicable legislation governing the sale of consumer goods; these rights are not affected by these Terms and Conditions or the applicable Agua de Oro Warranty.

16. REPAIRS
For any repair request related to a product ordered through our website, please refer to our FAQ section or contact our Customer Service.

17. PRODUCT DESCRIPTIONS
We make every effort to ensure that the information, including product descriptions, dimensions and colours, provided on the Platforms, in advertisements or in catalogues or communicated by Customer Service, is accurate and complete. However, we make no warranty, express or implied, as to the accuracy, reliability or completeness of such information.

18. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties relating to the Agua de Oro products, whether express or implied or otherwise, or arising out of any course of dealing, usage or trade practice.
Nothing in these Terms of Sale limits or excludes our liability for any liability which cannot be limited or excluded by applicable law.
Please note that in some countries consumer protection legislation may not provide for certain exclusions or limitations of warranties or liabilities and therefore some of the above exclusions and limitations may not apply.

19. GENERAL PROVISIONS
If any provision, or part thereof, of these Terms of Sale is held to be unlawful, void or unenforceable, such provision or part thereof shall be deemed not to be a part of these Terms of Sale and the legality, validity or enforceability of the remaining provisions of these Terms of Sale shall not be affected thereby, except to the extent required by applicable law.

These Terms of Sale (and any related terms incorporated by reference) constitute the entire agreement between you and us in respect of the ordering of products or services and supersede all agreements, draft agreements, understandings, undertakings or collateral agreements of any nature whatsoever entered into by the parties, whether oral or written, in respect of that subject matter.
We shall not be liable for any failure to perform or delay in performing or observing our obligations under these Terms of Sale arising from any cause beyond our reasonable control.
Our waiver of a breach of any provision of these Terms of Sale shall not be construed as a waiver of any other or subsequent breach.
This agreement is between you and us. No other person shall have the right to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will benefit from the applicable Agua de Oro Guarantee.

20. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions of Sale shall be governed by and construed in accordance with Swiss law, without reference to any conflict of law provisions. Any dispute, controversy or claim arising out of or relating to the Terms and Conditions of Sale, including the validity, invalidity, breach or termination of the Terms and Conditions of Sale, shall be tried or arbitrated in accordance with the Terms and Conditions of Sale. If Swiss law is different from the consumer law of your country, we will provide you with similar protection.
Without limiting any remedy available to you in a court of law, you and Agua de Oro will use their best efforts during a period of thirty (30) days to settle amicably any dispute or disagreement arising out of or relating to the product, the Terms of Sale or any breach thereof.
If you are a consumer residing in the European Union, you have the right to submit your complaint to an Alternative Dispute Resolution institution.
